On Copyright and Related Rights

If the author of the disseminated information is unknown or his/her identity and/or place of residence (location) cannot be established, as well as when the information is anonymous and access to the site is free, the proper defendant is the owner of the website on which the specified information material is posted, since it was he/she who created the technological opportunity and conditions for the dissemination of inaccurate information. Data about the owner of the website may be requested in accordance with the provisions of procedural legislation from the administrator of the system of registration and accounting of domain names and addresses of the Ukrainian segment of the Internet.
According to established practice in the field of registration and use of domain names special database on the Internet, the owner of the website may be a person other than the registrant of the domain name to whom such a website is addressed. In such cases, the owner of the website is determined in the agreement concluded with the registrant of the domain name. Information about the owner of the website may be obtained from the website hosting provider.
Article 1 of the Law of Ukraine "" stipulates that a website is a collection of data, electronic (digital) information, other objects of copyright and (or) related rights, etc., interconnected and structured within the address of the website and (or) the account of the owner of this website, access to which is carried out through an Internet address, which may consist of a domain name, entries in directories or calls and (or) a numerical address according to the Internet Protocol; a web page is a component of a website that may contain data, electronic (digital) information, other objects of copyright and (or) related rights, etc.; the owner of the website is a person who is the owner of the account and establishes the procedure and conditions for using the website. In the absence of evidence to the contrary, the owner of the website is considered to be the registrant of the relevant domain name under which the website is accessed and/or the recipient of hosting services.
